1. Acceptance of Terms
By creating an account, browsing our Site, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2. Account Registration
- You must be at least 16 years old to create an account and make purchases.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are solely responsible for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Products and Digital Goods
- All products sold on VTuberAvatars are digital goods delivered electronically.
- Product descriptions, images, and specifications are provided for informational purposes and may vary slightly from the actual files.
- We reserve the right to modify, discontinue, or update products at any time without prior notice.
4. License and Usage Rights
- Upon purchase, you are granted a non-exclusive, non-transferable, personal commercial license to use the purchased digital product.
- Permitted uses: Personal streaming (Twitch, YouTube, etc.), video content creation, social media content, personal branding.
- Prohibited uses: Reselling, redistributing, sublicensing, or sharing the files with third parties; claiming the artwork as your own original creation; using the model for NFT creation or blockchain-based projects without explicit written permission; using in any illegal, defamatory, or harmful context.
- One purchase = one license for one individual. If multiple people need to use the same model, separate licenses must be purchased.
5. Pricing and Payment
- All prices are listed in US Dollars (USD).
- Prices are subject to change without prior notice, but changes will not affect already completed orders.
- Payment is processed securely through Stripe. We do not store your credit card information.
- You agree to pay all charges at the prices in effect when incurred.
6. Delivery
- Digital products are delivered instantly via email download links and through your account dashboard after successful payment.
- It is your responsibility to download and securely store your purchased files.
- Download links may have expiration periods or download limits as specified per product.
7. Intellectual Property
All content on this Site — including but not limited to designs, artwork, text, graphics, logos, and software — is the property of VTuberAvatars or its content suppliers and is protected by international copyright, trademark, and intellectual property laws.
8. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse-engineer, decompile, or hack any part of the Site.
- Upload malicious code, spam, or engage in any activity that disrupts the Site.
- Impersonate another person or misrepresent your affiliation with any entity.
- Scrape, crawl, or use automated means to access the Site without our permission.
9. Limitation of Liability
To the maximum extent permitted by law, VTuberAvatars shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.
